Employees living in Spain have gained new rights in the coming months. Employers will now be obliged to assess the work risks of these professionals’ workplaces. The Department of Labor has enabled a free tool to prepare this assessment. Below, we explain how it works and other keys to this new regulation.
Where can I perform a risk assessment?

What should I do?

First, you must select the correct options on this initial screen and click Start.

Next, the system will ask you to verify your identity. Click “I want to register” to open an account. You can also access it using the Cl@ve system or electronic DNI.

Next, you need to specify the tasks for training your home-based employees.

Continuation is completed by responding to the questionnaire with “Yes”, “No”, or “Do not continue”.

What should I do with this document?
Keep it, give a copy to your employees at home and have it listed by the Labor and Social Security Inspector. There is no need to give the specific creature to anyone in advance. If you prepare it, the Labor Department will complain about it.

Can this process be outsourced?

What will a defaulting employer face?
Employers who do not comply with this new plan will be subject to sanctions regulating the Law on Violations of Public Order and Sanctions with a view to preventing labor risks. The ministry said failure to self-assess or fail to inform home-based employees of the precautions taken could be classified as a serious violation. The maximum penalty that the law imposes in this regard is a maximum of 49,180 euros. The Diaz ministry said such sanctions would only be imposed if there were aggravating factors. Otherwise, the most common violations are considered minor, with fines of up to 2,450 euros.
