Former TSE advisor Eduardo Tagliaferro filed a request for impeachment of Minister Alexandre de Moraes (STF) in the Federal Senate. The statement, dated November 11, 2025 and signed by lawyer Paulo César Rodríguez de Faria, claims that the minister acted in the course of being “suspected and prevented,” which the document says amounts to a crime of liability.
Taliaferro said he is “the victim, the defendant, and the judge” in the case involving Moraes. In the text, the complainant alleges that in addition to “by law adjudicating cases where he is a suspect in a case,” the minister also “determined the arrest and extradition ex officio in an Italian court.”

“Alexandre de Moraes is the accused and the alleged victim of criminal acts, the judge, the inquisitor, and the accuser,” one excerpt reads.
According to the petition, the minister’s actions violate the constitutional principles of due process, broad defense, and judicial impartiality.
“Impartiality is the basis of judicial power. A judge who appears to be simultaneously interested in the facts and in the trial of the accused undermines neutrality and invalidates the very essence of judicial provision,” the text states.
The defense also cited precedent from the STF itself to support its allegations. One of these is HC 164.493/PR, reported by Minister Edson Fassin, which recognizes the loss of impartiality of magistrates.
The document reproduces part of the judgment, stating that “judicial impartiality is enshrined as one of the cornerstones of ensuring due legal process. An impartial person is one who is not a party to the proceedings and does not adhere to the interests of those involved in the proceedings.”
In the final item, Mr. Tagliaferro asked the Senate to begin a process to remove Mr. Moraes from office “for the completion of the crime for which he is responsible,” saying the minister was “carrying out a process of a personal, persecutory and vengeful nature.”
The impeachment request was read out and sent to Senate President Davi Alcolumbre (Brazilian Unity) for final disposal according to the procedure set out in the bill.
STF gains majority by naming Tagliaferro as defendant
The STF’s first committee formed the majority that accepted the Attorney General’s Office’s (PGR) complaint against Taliaferro.
The charges against him are that he has acted against the legitimacy of the electoral process and obstructed investigations, including actions on January 8, 2023.
In its complaint, PGR accuses Tagliaferro of coercion during the process. Violation of functional secrecy. Obstructing investigations involving criminal organizations and attempting to violently overthrow the democratic rule of law.
The trial began on Friday (7/11) in a virtual plenary session, with rapporteur Alexandre de Moraes voting to name Tagliaferro as the defendant. Later, Ministers Cristiano Zanin and Flavio Dino also followed Moraes’ vote. The trial will run until November 14th.
