The Regional Court of Valencia has withdrawn a private appeal by Judge Nuria Ruiz Tobara of the Cataluja Region (Valencia) requesting that the Dana case be transferred to the High Court of the Autonomous Region of Valencia (Tsjcv) and that Carlos Mazon, acting president of the central government of Valencia, be investigated. TSJCV officials said prosecutors believe Mazon should have asked the central government to declare a national emergency during the October 29, 2024 flood that killed 229 people.
The six judges of the Valencian regional court therefore confirmed the judgment handed down by the Cataluja regional judge last May. The lecturer refused to send a reasoned statement against the Generalitat Chairman to the TSJCV, citing lack of authority. He also refused to mention socialist Pilar Bernabe, the head of the Valencian government, as a target of the investigation.
After considering the motion, the court found the instructor’s decision to be “reasonable” and held that the appeal should be “directly dismissed.”
According to the order, although the appellants have not “adequately” argued that the “requirements set forth by the TSJCV’s order” have been met, the TSJCV refused to commence proceedings in December 2024 as a result of complaints and grievances to the Consul General over the conduct during Dana. For magistrates, the current appeal does not include a “sufficient justification for LOPJ Article 11 budgetary consent” (Judiciary Institutions Act).
In the same resolution, the Second Chamber once again rejects the request for prosecution by the representatives of the Government of the Valencian Community, since the appeal does not contain “new arguments” justifying the adoption of a different judgment than what the same court had already resolved in a previous resolution on the same issue.
The court issued a second order, also notified on Wednesday, dismissing another private prosecution appeal, in which it asked Judge Catalloja to summon several witnesses, including the former Secretary of State for Security and the President of the Transport and Sustainable Mobility Court.
