Marsal ordered to pay Tabata Amaral 280,000 reais for defamation

Influencer and businessman Pablo Marzal was sentenced on Thursday (11/13) by the Electoral Court of São Paulo to pay more than 280,000 reais to Federal Representative Tabata Amaral (PSD) for defaming a member of parliament.

The conviction refers to an episode from last July 4, when both men were primary candidates in the Sao Paulo mayoral race. In the podcast, Marsal connected the deputy’s visit to Harvard to a delicate moment her father was experiencing during a period of change.

“I also had a father who was an alcoholic, but his family helped him and he stopped drinking. Her father, she went to Harvard, and her father eventually passed away. I can only imagine what she could do for the people of São Paulo,” Marsal said at the scene.

Prosecutors at the election court understood that the businessman had defamed Mr. Tabata “for the purpose of election propaganda and on grounds of harm to his reputation.”

According to the complaint signed by prosecutor Kleber Rogerio Masson, Marzal tried to damage Tabata’s reputation “to gather in her favor votes that should have been destined for her in the eyes of the electorate of São Paulo.”

Convicted of electoral defamation

The court accepted the complaint and sentenced the influencer for defaming the election (Article 325 of the Election Law).

He was sentenced to a restrictive penalty consisting of payment of money in favor of the offender, equivalent to the minimum wage of $200, and seven days of payment of a fine, equivalent to the minimum wage of $5.

This calculation is done using the basic salary of R$1,418.00 on the date of the incident. Therefore, Tabata will have to pay a penalty of 282,400 reais, and an additional 49,630 reais on a sunny day.

In the ruling, the election judge emphasized, “Although it was still considered to be the pre-candidacy period, it is clear that the defendant was attempting to influence voters’ choices by introducing false information regarding the privacy of Mr. Tabata, who was a potential candidate at the time.”

Marsal was contacted for comment on the court’s decision but did not respond until publication of this report. This space will remain open for demonstrations.
