The Public Ministry of Rio Grande do Sul (MPRS) has filed an extraordinary and special appeal with the Federal Supreme Court (STF) and the Superior Court of Justice (STJ) to revoke the judgment of the State Court of Justice (TJRS) that commuted the sentences of the four defendants convicted in the Kiss nightclub tragedy. The document was submitted on Monday (10th) by the Appeals and Prosecution Service, through Attorney General Flavia Mallmann, with the aim of reinstating the conviction imposed by a jury court in December 2021.
This effort aims to challenge the understanding of the TJRS’s First Special Criminal Court, which maintained the validity of the trial but reduced the sentence from 18-22 years to 11-12 years in prison. Prosecutor Flavia Mallmann said MPRS respected the sentence but believed the punishment was “significantly reduced” and did not commensurate with the seriousness of the tragedy and the number of victims.
The appeal is currently undergoing an evidentiary analysis before the Second Vice-President of the TJRS, who will assess whether it meets the legal requirements to be sent to the High Court of Brasilia. The Kiss nightclub tragedy in Santa Maria in January 2013 killed 242 people and injured more than 600, and is considered one of the worst domestic fire disasters in the country.
