Federal Judge Alejo Ramos Padilla of the state of La Plata has decided to withdraw from the investigation initiated by Liberal lawmaker Marcelo Mazzeo, who had accused Governor Axel Kisilov and the head of the Medical Assistance Works Institute, Homero Giles. The judges argued in their ruling that the facts presented must be analyzed by state jurisdiction.
According to the judgment, the reported crimes do not harm the national interest and concern the management of an organization that is solely dependent on the province of Buenos Aires. Therefore, the submission will be sent to the corresponding Court of Guarantee of the Department of Justice of La Plata.
The resolution is based on precedent that limits federal court intervention to cases that directly affect the nation. Ramos Padilla emphasized that even if funds are transferred from the state, once they are incorporated into the state budget, their management is the responsibility of the local judiciary.
The case promoted by Mazzeo thus returns to the Buenos Aires region, as expected by lawyers who had questioned the initial claim to federal jurisdiction. This measure puts an end to the debate over jurisdiction and allows the investigation to continue within normal judicial frameworks.
