How long should SP City Hall regulate motorcycle taxi services? What is happening now?

Ricardo Nunez (MDB) announced that traffic regulations need to be decided by December and that he is betting on PL in Congress to stop traffic in the capital of São Paulo.

Mayor Ricardo Nunez (MDB) has been in a legal dispute since 2023 against platforms such as 99 and Uber that are introducing motorcycle passenger transport services in São Paulo. Nunes cites the risk of increased accidents, while companies defend the method as an alternative to traveling in areas without public transport.

However, the mayor continues to lose in these conflicts. After the 2023 Decree was declared unconstitutional by TJ-SP; The Federal Supreme Court (STF) also ruled that Law No. 18,156/2025 was unconstitutional.The São Paulo government approved it in June this year, giving local governments the power to veto and approve motorcycle taxis and motorcycle apps.

In both cases, the decisions were motivated by direct constitutional claims (ADIs) filed by the Confederation of National Service (CNS), which argued that state regulations infringed on federal authority to legislate traffic and transportation laws.

In suspending the law by injunction, the rapporteur, Minister Alexandre de Moraes, pointed out that the regulation would create standards and requirements not foreseen by federal law and would allow local governments to regulate services in a manner inconsistent with those established by the federation. All other ministers followed suit.

Nunes disputed the decision, saying there was no violation of jurisdiction. “If they (Minister of STF) Understand that there is a gap in federal law — from my perspective, there is no gap — that they could have had the sensibility to create an order so that we could protect lives,” the mayor said on Monday’s agenda.

STF and TJ understand that City Hall does not have the power to block the service, but as this activity is not yet regulated, this type of transportation is not provided.

Operation with a bill in Congress

City Hall did not respond to questions about how it plans to regulate the service, whether through legislation or by holding public hearings.

“We have already spoken with President Davi Alcolumbre in the Senate and with President Hugo Motta in the House of Representatives. We have collected all the data and statistics and have shown the importance of approving this law,” Nunes said.
