Jakarta (ANTARA) – In the Indonesian parliamentary system there is an internal institution whose role is to maintain the honor and monitor the ethics of the people’s representatives in Senayan.
This institution is the Honor Council Court (MKD), which is part of the apparatus of the People’s Representative Council of the Republic of Indonesia (DPR RI), is permanent, and has the function of enforcing the code of ethics and conduct of the members of the DPR.
The MKD was established on the basis of law number 17 of 2014 concerning MPR, DPR, DPD and DPRD, which was updated with law number 13 of 2019. This institution was previously known as the Honorary Council (BK).
The purpose of its formation is to ensure that the people’s representatives carry out their duties with full responsibility, integrity and uphold the dignity of the legislative institution.
In short, the MKD is like a “court” within the DPR. This institution evaluates and decides on alleged violations of the behavior of DPR members, resulting from reports from the public, other DPR members or the DPR leadership.
It is forbidden to intervene in all decisions made by the MKD, members, faction leaders or leaders of the DPR.
However, the case handled by MKD is not a criminal case, but only an ethics case that focuses on the behavior and compliance of the board members.
In carrying out the session, the leadership of the MKD is collective and collegial, consisting of a president and four vice-presidents.
The DPR RI MKD consists of 17 members, determined through the Plenary Assembly of the DPR at the beginning of the mandate or at the beginning of the session year.
The selection of MKD members is carried out based on the principle of deliberation to reach a consensus and taking into account the proportionality of the factions and the representation of women.
After being elected and carrying out their duties, MKD members are expected to act independently and be free from the influence of other factions or parties. This is in accordance with the Presidential Decree RI Number 1 of 2015 concerning the Presidential Code of Ethics.
MKD tasks
According to the RI Presidential Decree Number 2 of 2015 relating to MKD Procedures, this institute has the main tasks, including:
1. Carry out monitoring as part of a preventative function on member behaviors so that they do not violate member obligations
2. Conduct investigations and verify complaints against members
3. Hold a hearing to consider actions or events alleged to have been committed by members as violations
4. Receive a letter from law enforcement regarding notification, citation, or investigation of members suspected of committing a criminal act
5. Request information from law enforcement regarding the notification, citation or investigation of members suspected of committing a criminal act
6. Request information from members suspected of committing criminal acts
7. Give written approval or disapproval regarding summons and requests for information from law enforcement agencies to members of the DPR
8. Accompany the police in carrying out searches and seizures of members suspected of having committed criminal acts.
MKD Authority
In addition to these duties, MKD also has the authority to carry out its own tasks, including:
1. Distribute to all members a circular containing recommendations for respecting the rules and preventing violations of the code of ethics
2. Monitor the behavior and participation of members in DPR meetings
3. Provide recommendations to related parties to prevent the occurrence of auctionswarranty code of ethics and maintenance of dignity, honor, image and beliefdifficulty Presidential Decree
4. Follow up on alleged violations of the code of ethics committed by members, both on the basis of complaints and without complaints
5. Summon and examine any person connected to acts or facts committed by members, whether they fail to fulfill their obligations or sendfencing rule
6. Collaborate with other institutions
7. Call related parties
8. Stop the case review process in each trial in case the complaint is withdrawn or decided by the MKD meeting
9. Decide on cases of violations allegedly committed by members
10. Prepare a draft budget for the implementation of the tasks of MKD and submit it to the domestic affairs agency
11. Perform an assessmentuation and the improvement of the DPR regulations regulating tentsang Code of Ethics.
With these tasks and authorities, the MKD not only plays a deterrent and control role, but also as a guardian of the dignity and honor of state legislative institutions.
