Former President of the Central Court Carles Puigdemont expressed some disbelief at the report of the Advocate General of the Court of Justice of the European Union (CJEU), which upheld the amnesty law this Thursday. “Let’s not forget that the last word belongs to some judges who felt a calling to save the country.” The report objects only at the stated times, points out that the law was given “in a real context of political and social reconciliation” and rejects that it is a “self-amnesty”. Meanwhile, Jordi Trull, general secretary of Junz, hailed the CJEU’s announcement as a victory for those who are not yet covered by the amnesty law. “Today is a small procedural step, but a big step for the return of asylum seekers,” he said. Puigdemont’s lawyer, Gonzalo Boé, said the former Catalan president’s return to Spain was a “political decision” that he would have to make, but that he believed he would be able to return if the EU Court of Justice ultimately approved the amnesty law.

On his side, president Generalitat Salvador Ira expressed his satisfaction. “This is an important step, a resolution that sets the framework for discussion,” he said in his closing speech of the day. I once again urge that the law beneficial to Catalonia and Spain be applied promptly and without subterfuge.” ERC leader Oriol Junqueras also trusts that the court will adopt the same position and “pave the way” for the Constitutional Court to apply the law. Junqueras stressed that “there has never been any embezzlement or rebellion, nor have there been any charges that justify this judicial and criminal persecution that has led to the expulsion and imprisonment of many of our citizens.”
In early October, the Constitutional Court accepted by an 8-4 vote the Yuntz party leader’s appeal against the Supreme Court’s decision not to apply amnesty to embezzlement charges, but the arrest warrant issued against the party leader remains in force if he is found to be in Spain. For Puigdemont, the pardon does not apply because “there are instructions that some courts, including the Supreme Court, blindly follow.” Puigdemont is being supported by the government to return to Spain. Presidential Minister Félix Bolaños reiterated that it was “the intention of the parliamentarians” for the pardon to cover “all leaders” involved in the independence process.
