What started as an altercation between two University of Brasilia (UnB) students eventually escalated into a police incident that resulted in the arrest of a 23-year-old student. The incident occurred on Tuesday (11/11) at approximately 6:00 pm on the Darcy Ribeiro Campus.
According to the findings of the 5th Police Station (Chubu District), a student who identifies as non-binary entered the women’s restroom of the Central Institute of Science (ICC) to use a mirror. Some of the students in the agricultural science course at the same facility were surprised to see him enroll.

According to the report, the female university student’s colleague responded by saying, “I’m biologically male, so I shouldn’t be there.” A heated discussion has since spread to the university’s courtyard and was witnessed by other students.
“Viaginho” and “Jack”
During the disagreement, the student allegedly called his colleague a “faggot” and “jack,” which is slang for calling someone a “rapist.” Offended students contacted campus security, and the Federal District Military Police (PMDF) was ordered to respond to the incident.
Both were taken to the police station for explanations. In his testimony, the non-binary person said he usually uses both men’s and women’s restrooms and feels like the victim of homophobic insults.
During interrogation, the student admitted to preventing a colleague from using the women’s restroom and admitted to using offensive language. During her deposition, she smiled and scoffed when she heard the victim’s name, according to police records.

The case was framed as a racial slur in the form of a homophobic slur, in accordance with the understanding of the Supreme Court of the Federation (STF) in Direct Action for Unconstitutionality by Omission (ADO 26). In view of this, the police authorities charged the student without the right to bail at police headquarters under Article 2A of Law 7,716/89.
On the way to the police station, a friend of the victim posted a message on social media calling the poster a “bitch.” He was also charged with contempt.

When contacted by Column, the University of Brasilia (UnB) reported that it is responsibly pursuing the incident in cooperation with the competent institutions and reaffirmed its commitment to human rights, diversity and respectful coexistence in the university community.
This body provides support and oversight to both parties, ensuring respect for individual rights, broad defense, and integrity of both parties.
