Court cancels SP Guaruja tourism tax – 2025/11/12 – Daily life

The decision of the São Paulo Court of Justice has invalidated the provisions of the law governing the charging of tourist and charter buses to visit Guarujá in Baixada Santista.

According to the Ministry of Public Affairs, which drafted the lawsuit, the TJSP’s special agency accepted a direct action for unconstitutionality against the regulation, which imposes fees ranging from R$926 to R$4,630 per day for allowing the entry of vehicles with more than eight seats from other municipalities, and fines ranging from R$2,000 to R$8,000 per day in case of violation.

According to the Ministry of Public Affairs, the court’s decision agreed that “the established fees do not show any correlation between the amount charged and the cost of state activities and do not in fact constitute fees for the use of public assets.”

When contacted, Guaruja City Hall did not comment on the decision.
