The Ministry of Labor asserted that the website’s failure to assess domestic workers’ occupational risks was due to a “malicious attack.” This is what Yolanda Díaz’s department indicated in a statement sent to the media: “Important information regarding the Prevencion10.es application for the assessment of occupational risk prevention of domestic workers: This application is experiencing an outage, which was initially recognized as being overloaded due to the high influx of users, but was ultimately confirmed to be a malicious attack. We are working to restore it as soon as possible. Thank you for your understanding.”
According to ministry officials, a series of bot “Automatic” “artificially” overloads the platform and sends a large number of requests. The same source does not quantify the volume of this request or the origin of the request. No charges have been filed with police authorities at this time.
This Friday, November 14th, marks six months since Trabajo launched the website prevencion10.es. As the ministry explained at its launch, the tool is a “free and open-access preventive measure” that “enables employers to comply with new legal obligations.” In other words, this website allows people who employ domestic workers to complete an occupational risk self-assessment at home. After a full semester of website launch, employers of domestic workers will be requesting what they are considering from a prevention perspective.
Failure to carry out a self-assessment or to notify domestic workers of the precautions being taken may be classified as a serious violation. With this in mind, the maximum penalty included in the bill is a maximum penalty of 49,180 euros. Yolanda Díaz’s department has stressed that this type of sanction can only be given if the situation worsens. Without these, violations will most commonly be considered minor, with fines of up to €2,450.
