Flamengo striker Bruno Henrique’s appeal in a sports manipulation case was rejected by the Grand Chamber of the High Court of Sport Justice (STJD) this Thursday (11/13). The player was found guilty of forcing a yellow card against Santos in the 2023 Brazilian Championship. The player will not be suspended, but will have to pay a fine of R$100,000.

At this Thursday’s session, the athlete was cleared under Articles 243 and 243A. The jury understood that the athlete did not intentionally accept the cards to benefit his brother, Wander Nunez Pinto Jr., in sports betting.

The trial began last Monday (10/11), with the STJD court rejecting a statute of limitations request filed by the athlete’s defense. The court then proceeded to vote on the dosimetry part of the ruling, but Comptroller Marco Aurelio Choi requested a reconsideration and postponed the conclusion of the case.

Before the review request, the rapporteur of the case, Sérgio Furtado Filho, voted to acquit the assailant, who was found guilty in the trial court, under Article 243-A. He proposed punishing Bruno Enrique under article 191 with a fine of R$100,000 and no suspension. However, other companies in the industry did not follow suit.

The player was handed a 12-game suspension and a R$60,000 fine by the STJD’s First Disciplinary Committee on September 4. The guilty verdict in the second trial means the Flamengo striker will miss the final match of the Brazilian Championship with the club, which is currently second in the competition.

Bruno Enrique was included in Articles 243 (section 1) and 243-A of the Brazilian Sports Justice Law. Check it out:

  • Article 243: Intentionally performing an act that is harmful to the team being defended.
