Lawyers for former TSE advisor Eduardo Tagliaferro have submitted allegations against Minister Alexandre de Moraes to STF President Edson Fasin. Defense attorneys are alleging hostility, personal interest and limitation of defense after their request for in-person oral argument was denied in a virtual plenary session.
The petition, filed this Sunday (9/11), calls for an immediate cessation of all actions taken by Mr. Moraes in the process. The defense argues that the minister acts as “defendant, victim and judge” and that the virtual trial, which began on November 7, violates contradictory and broad defense rules.

Lawyers Paulo César Rodríguez de Faria and Filipe Rocha de Oliveira argue that Moraes maintained the electronic trial despite formal objections from the defense and are demanding that the files be redistributed to another minister. The request also refers to a complaint Tagliaferro made in 2024 about alleged irregularities in the conduct of the investigation based on Moraes’ report, which the minister would have refuted on the record.
STF gains majority by naming Tagliaferro as defendant
The STF’s first committee formed the majority that accepted the Attorney General’s Office’s (PGR) complaint against Taliaferro.
The charges against him violate the legitimacy of the electoral process and obstruct investigations into the actions of January 8, 2023.
In its complaint, PGR accuses Tagliaferro of coercion during the process. Violation of functional secrecy. Obstructing investigations involving criminal organizations and attempting to violently overthrow the democratic rule of law.
The trial began on Friday (7/11) in a virtual plenary session, with rapporteur Alexandre de Moraes voting to name Tagliaferro as the defendant. Later, Ministers Cristiano Zanin and Flavio Dino also followed Moraes’ vote. The trial will run until November 14th.
