This Monday, Bruno Enrique will finally be tried by the Supreme Court of Sports Justice (STJD). The Flamengo striker was handed a 12-match suspension and a R$60,000 fine by a first-umpire judge in early September for forcing a yellow card in order to benefit a bettor in 2023. However, the defense has appealed and is acting on the suspension. Today’s session in central Rio de Janeiro begins at 10am and could decide the future of the session.

The number 27 was condemned by a majority vote (4 to 1), as Article 243-A of the Brazilian Code of Sports Judiciary (CBJD) stipulates “acts contrary to sporting ethics in order to influence the outcome of a match.” The card in question was received on November 1, 2023, during the Brasileirans’ match against Santos at Mane Garrincha in Brasilia.

In addition to Bruno Enrique, who was also a defendant in the General Court, four amateur players who bet on the match were convicted. The younger brother of the Flamengo player, Wander Nunes Pinto Junior (suspended for 12 games), Claudinei Vitor Mosquete Bassan (suspended for 14 games), Andril Sale Nascimento dos Reis and Douglas Ribeiro Pina Barcelos (both suspended for 6 games). Both the defense and the prosecutor’s office can appeal the decision. One side wants all convictions to be annulled, while the other wants athletes to serve longer sentences (up to two years) and that it apply to all competitions. For example, to apply a penalty to a Libertadores match, the CBF must make a request to FIFA and instruct the organization to apply the penalty.

The full trial of Bruno Enrique, Andril, and Clodinay was previously scheduled for the last week of October, but the STJD postponed all trials due to a large-scale police operation in Rio de Janeiro’s Peña and Alemán complexes.

The Plenum is the last sports venue in the country, but depending on the outcome, the parties may file a lawsuit with an international body such as the Court of Arbitration for Sport (CAS).

On what grounds was Bruno Enrique put on trial?

Bruno Henrique was accused of sharing preliminary information about the yellow card he received in the match against Santos at the Mane Garrincha Stadium in Brasilia on November 1, 2023. This action would have benefited his younger brother Wander, who would have passed the information on to his friends.

In addition to these two, Claudinei Vitor Mosquete Bassin, Andril Reis, and Douglas Barcelos were also charged and convicted by STJD. Wander’s wife, Ludimila Araujo Lima, and Bruno Enrique’s cousin, Poliana Esther Nunez Cardoso, are also implicated, but neither are known to the court.

The First Disciplinary Committee of the STJD formed a majority (4:1) to censure Flamengo striker Bruno Enrique in the first instance, under Article 243-A of the Brazilian Sports Judicial Code (CBJD), for forcing a yellow card and benefiting bettors in the Brasileirão match against Santos at Mane Garrincha in 2023. The penalty voted on by the four auditors was 12 games and a fine of 60,000 reais.

  • Auditor and Rapporteur Alsino Guedes initiated a vote to acquit Bruno Henrique under article 243 of the CBJD, but chose to convict the player under article 243-A, asking for a minimum sentence of 12 games in prison and a fine of R$60,000.
  • Auditor Guilherme Martorelli revealed that Bruno Henrique had been ordered to take a yellow card from the club, but said this was not a loss for the organization. He therefore acquitted him in 243. Regarding 243-A, he pointed out that game strategy and operation should not be confused, and also acquitted him. However, he was found guilty under Article 191 and fined R$100,000.
  • Comptroller William Figueiredo voted for acquittal under articles 243 and 191, but following the reporter, citing evidence of messages between Bruno Henrique and his brother, accepted the charge under article 243-A, imposing a 12-game prison term and a fine of 60,000 reais.
  • Comptroller Carolina Ramos also voted in favor of the conviction under Article 243-A, which would result in a sentence of 12 games in prison and a fine of R$60,000.
  • President Marcelo Rocha took a similar decision, condemning Bruno Enrique under Article 243-A and demanding a prison term of 12 games and R$60,000.

During the trial, the attacker’s defense argued that Flamengo was not harmed by the act. He added that the club advised him to receive a yellow card for the next game against Fortaleza, in order to be suspended. A strategy that guarantees the presence of Bruno Enrique in the match against Palmeiras.

In its appeal, the public prosecutor’s office stresses that Bruno Enrique informed his relatives that he would receive a third yellow card and profited personally from the information. It argued that the incident was a loss to the club as it had a far-reaching impact on the player’s value on the market.

Since when has Bruno Enrique been under investigation?

The case has been investigated by the Federal Police and the Federal Ministry of Local Government since August last year, when three bookmakers detected unusual bets and movements of cards for the attackers in the match.

The player’s cell phone was searched and seized in November, but the STJD closed the case. In April of this year, Bruno Enrique was indicted by the PF on charges of embezzlement and fraud in sports competitions. The agency had access to conversations between the player and his brother, proving that the card information was expected. In June, it was criticized by members of Congress. If sentenced to the maximum penalty in the general field, the athlete could face up to 17 years and eight months in prison.
